Course Outline:
- The constitutional status of the Virgin Islands as an Overseas Territory (OT) of the United Kingdom.
- Important statutory framework: the VBI Companies Act 2004, Insolvency Act 2003 and Insolvency Rules
2003, and the BVI Arbitration Act 2013.
- BVI Legal System and the jurisdiction of the BVI Courts in dispute resolution, with particular focus on
the role of the Commercial Court, and BVI Arbitration Centre as a centre for settlement of international
commercial disputes.
- Some recent challenges: Public Registers of Beneficial Ownership of BVI incorporated companies, the
BOSS Act and system, economic substance and the Economic Substance (Companies and Limited
Partnerships) Act 2018.
- The way forward for the British Virgin Islands in the new and evolving global regulatory framework.
