Course Outline:

  1. The constitutional status of the Virgin Islands as an Overseas Territory (OT) of the United Kingdom.
  2. Important statutory framework: the VBI Companies Act 2004, Insolvency Act 2003 and Insolvency Rules

 2003, and the BVI Arbitration Act 2013.

  1. BVI Legal System and the jurisdiction of the BVI Courts in dispute resolution, with particular focus on

  the role of the Commercial Court, and BVI Arbitration Centre as a centre for settlement of international

commercial disputes.

  1. Some recent challenges: Public Registers of Beneficial Ownership of BVI incorporated companies, the

  BOSS Act and system, economic substance and the Economic Substance (Companies and Limited

Partnerships) Act 2018.

  1. The way forward for the British Virgin Islands in the new and evolving global regulatory framework.
